Are tourists protected by the Bill of Rights? Do all people in the US, whether a citizen or not, have constitutional rights and protection? According to the 14th Amendment “all persons” within the jurisdiction of a state are afforded equal protection of the laws. This allows for no distinction to be made between citizen and non-citizen.
